1. Acceptance of Terms

By accessing or using the Drive on Sunshine website (www.driveonsunshine.co.za) or engaging our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use our website or services. These Terms constitute a legally binding agreement between you ("Client", "you", or "your") and Drive on Sunshine (Pty) Ltd ("Drive on Sunshine", "we", "us", or "our"), a company registered in the Republic of South Africa. These Terms are governed by the Electronic Communications and Transactions Act 25 of 2002 (ECT Act), the Consumer Protection Act 68 of 2008 (CPA), and the Protection of Personal Information Act 4 of 2013 (POPIA).

2. Definitions

"Services" means solar energy infrastructure design, supply, installation, commissioning, and maintenance services for electric vehicle (EV) charging systems. "Equipment" means all hardware components supplied by Drive on Sunshine, including solar panels, batteries, inverters, charge controllers, EV charging stations, monitoring devices, and associated cabling and mounting hardware. "Quotation" means a formal written price estimate provided by Drive on Sunshine for specified Services and Equipment. "Installation Site" means the property at which Services are to be performed. "System" means the complete solar EV charging infrastructure installed at the Installation Site. "POPIA" means the Protection of Personal Information Act 4 of 2013.

3. Services

Drive on Sunshine provides the following services: 3.1 FREE EV READINESS ASSESSMENT — A no-obligation site evaluation to assess roof space, electrical infrastructure, EV specifications, and daily driving patterns. Assessments are provided at no charge and carry no commitment to purchase. 3.2 SYSTEM DESIGN — Custom solar EV charging system design based on your assessment results, EV specifications, and energy requirements. 3.3 SUPPLY OF EQUIPMENT — Procurement and supply of specified Equipment from approved manufacturers and distributors. 3.4 PROFESSIONAL INSTALLATION — Installation of the System by registered electricians in compliance with SANS standards and local authority regulations. 3.5 CERTIFICATE OF COMPLIANCE (COC) — Issuance of an electrical Certificate of Compliance upon completion of installation, as required under the Occupational Health and Safety Act. 3.6 COMMISSIONING AND HANDOVER — System testing, commissioning, and client handover including demonstration of monitoring applications. 3.7 AFTER-SALES SUPPORT — Technical support and maintenance services as specified in your service agreement.

4. Quotations, Pricing & Payment

4.1 All quotations are valid for 30 days from the date of issue, unless otherwise stated. Prices are subject to change without notice after the validity period. 4.2 All prices are quoted in South African Rand (ZAR) and include VAT at the current applicable rate unless explicitly stated otherwise. 4.3 Package prices displayed on our website are indicative estimates. Final pricing is determined by your site assessment, roof configuration, electrical DB capacity, cabling runs, and specific equipment selection. 4.4 A deposit of 50% of the total quoted amount is required to confirm your installation booking. The balance is due upon completion and commissioning of the System, before the COC is issued. 4.5 Payment methods accepted: EFT bank transfer, credit card (subject to processing fees). All payments must be received and cleared before installation commences. 4.6 Drive on Sunshine reserves the right to adjust pricing if site conditions materially differ from those assessed, or if equipment costs change due to exchange rate fluctuations, manufacturer price increases, or supply chain factors beyond our control. Any such adjustments will be communicated and agreed in writing before work proceeds. 4.7 Finance options may be available through approved third-party lenders. Drive on Sunshine is not a financial services provider. Financing terms, interest rates, and approval are solely at the discretion of the relevant financial institution. Drive on Sunshine does not guarantee loan approval.

5. Installation

5.1 Installations are carried out by qualified, SAQCC-registered electricians and trained solar installers. All work complies with applicable SANS standards and local municipal bylaws. 5.2 The Client is responsible for ensuring safe, unobstructed access to the Installation Site on agreed installation dates. Failure to provide access may result in rescheduling fees. 5.3 Installation timelines are estimates only. Drive on Sunshine is not liable for delays caused by weather, supply chain disruptions, municipal inspection scheduling, or factors outside our reasonable control. 5.4 The Client is responsible for obtaining any necessary body-corporate, homeowners' association, or landlord approvals prior to installation. Drive on Sunshine may assist with documentation but cannot be held responsible for approval delays or refusals. 5.5 The Client must ensure that the electrical DB board, roof structure, and mounting surfaces are in adequate condition to support the installation. If structural or electrical deficiencies are discovered during installation, additional work and costs may apply and will be quoted separately. 5.6 Upon completion, the Client will participate in a handover walkthrough. Signing the completion certificate indicates satisfaction with the installation. Punch-list items noted at handover will be remedied within a reasonable timeframe.

6. Equipment & Warranties

6.1 All Equipment is supplied with manufacturers' warranties as per the relevant product documentation. Drive on Sunshine facilitates warranty claims but is not the manufacturer and cannot be held liable for manufacturer warranty decisions. 6.2 WORKMANSHIP WARRANTY — Drive on Sunshine warrants all installation workmanship for a period of 12 months from the date of commissioning. This warranty covers defects arising from our installation work and does not cover damage caused by third parties, Acts of God, load shedding-related power surges, or Client misuse. 6.3 SOLAR PANELS — JA Solar panels carry a 12-year product warranty and a 25-year linear power output warranty as specified by the manufacturer. 6.4 BATTERIES — Freedom Won battery warranties vary by product: - eTower 5kWh: 5-year / 5,000-cycle warranty - LiTE Home series: 10-year / 6,000-cycle warranty Full warranty terms are available from Freedom Won (www.freedomwon.co.za). 6.5 VICTRON ENERGY EQUIPMENT — Inverters, MPPT controllers, EV charging stations, and monitoring devices carry Victron Energy's standard 5-year warranty. Full terms at www.victronenergy.com. 6.6 Warranties are void if Equipment is tampered with, modified, or serviced by unauthorized parties. All warranty work must be performed by Drive on Sunshine or an authorized Victron Energy dealer. 6.7 The Consumer Protection Act 68 of 2008 may provide additional rights regarding defective goods and services.

7. Client Obligations

7.1 You agree to provide accurate and complete information during the assessment and installation process. Providing false information that affects system sizing or installation may void warranties and incur additional costs. 7.2 You are responsible for the safe operation of the System and must follow all operating instructions provided during handover and in accompanying documentation. 7.3 You must not modify, tamper with, or permit unauthorized persons to work on the System. 7.4 You must maintain appropriate home insurance that covers the installed System. Drive on Sunshine is not responsible for insurance arrangements. 7.5 You must notify Drive on Sunshine promptly of any System faults, alarms, or irregularities. 7.6 You must not use the website for any unlawful purpose, to transmit malicious code, or to attempt unauthorized access to any systems.

8. Intellectual Property

8.1 All content on www.driveonsunshine.co.za — including text, graphics, logos, images, software, and designs — is the intellectual property of Drive on Sunshine (Pty) Ltd or its licensors and is protected by South African and international copyright law. 8.2 You may not reproduce, distribute, modify, or commercially exploit any content from this website without prior written consent from Drive on Sunshine. 8.3 Product images of Victron Energy, Freedom Won, and JA Solar products remain the property of their respective owners and are used with reference to manufacturer published materials.

9. Privacy & Data Protection (POPIA)

9.1 Drive on Sunshine is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). 9.2 We collect personal information including your name, email address, telephone number, vehicle details, and property information for the purpose of providing assessments, quotations, and installation services. 9.3 Your information is used solely for service delivery, communication about your enquiry or installation, and where consent is obtained, for marketing communications. 9.4 We do not sell or share your personal information with third parties except as required by law, or with service providers who assist in delivering our services under appropriate data processing agreements. 9.5 You have the right to: access your personal information; request correction of inaccurate information; request deletion of your information (subject to legal retention requirements); withdraw consent for marketing communications at any time; and lodge a complaint with the Information Regulator of South Africa. 9.6 To exercise your POPIA rights, contact us at info@driveonsunshine.co.za. 9.7 Our full Privacy Policy is incorporated into these Terms by reference.

10. Cookies & Tracking

10.1 Our website uses cookies and similar tracking technologies to improve user experience, analyse website traffic, and where you have provided consent, to deliver relevant marketing communications. 10.2 You can manage your cookie preferences through the cookie consent banner displayed on your first visit, or by accessing your browser settings at any time. 10.3 Our full Cookie Policy, which explains the types of cookies used, their purpose, and how to manage them, is available at www.driveonsunshine.co.za/cookie-policy. 10.4 Declining non-essential cookies will not prevent you from using our website or requesting a service assessment.

11. Disclaimers & Limitation of Liability

11.1 SAVINGS ESTIMATES — Energy savings, ROI calculations, and payback periods displayed on our website are estimates based on average South African fuel prices, solar irradiance data, and typical usage patterns. Actual results will vary based on individual driving habits, Eskom tariffs, weather conditions, and system configuration. These estimates do not constitute a guarantee or contractual commitment. 11.2 WEBSITE CONTENT — Information on this website is provided in good faith for general informational purposes. While we endeavour to keep information accurate and up to date, we make no representations or warranties of any kind as to the completeness or accuracy of the content. 11.3 To the maximum extent permitted by applicable South African law, Drive on Sunshine shall not be liable for: indirect, incidental, or consequential loss or damage; loss of profit, revenue, or anticipated savings; damage to property caused by factors outside our installation workmanship; loss or corruption of data. 11.4 Our aggregate liability to you in connection with any claim arising from our Services shall not exceed the amount paid by you to Drive on Sunshine for the specific Services giving rise to the claim. 11.5 Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud, or for any other liability that cannot lawfully be excluded under the CPA or POPIA.

12. Indemnification

You agree to indemnify and hold harmless Drive on Sunshine, its directors, employees, and agents from any claims, losses, damages, costs, or expenses (including legal fees) arising from: your breach of these Terms; your violation of any law; inaccurate information provided by you; or unauthorized use of the System by third parties where the System is under your care.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or our Services shall be subject to the exclusive jurisdiction of the South African courts. The Magistrates' Court or High Court with jurisdiction over the district in which Drive on Sunshine's registered office is situated shall have jurisdiction over any disputes.

14. Dispute Resolution

14.1 In the event of a dispute, the parties agree to first attempt resolution through good-faith negotiation within 20 business days of written notice of the dispute. 14.2 If negotiation fails, the dispute shall be referred to mediation under the auspices of the Arbitration Foundation of Southern Africa (AFSA) before resorting to litigation. 14.3 Consumers have the right to refer disputes to the National Consumer Commission (NCC) or the relevant Ombud in terms of the Consumer Protection Act.

15. Changes to These Terms

Drive on Sunshine reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
